Terms of Service

Welcome to SMS Gateway Master. By installing, accessing, or using our application ("the app"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance of Terms

By downloading, installing, or using SMS Gateway Master, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, please do not install or use the app.

2. Description of Service

2.1 Core Features

SMS Gateway Master provides the following services:

• Send and receive SMS/MMS messages
• Manage conversation threads
• Support for RCS messaging (when available)
• Contact integration
• Message organization and search
• Delivery and read receipts
• Optional Firebase authentication for future cloud features

2.2 Default SMS Application

SMS Gateway Master functions as a default SMS application. When set as default, the app will handle all incoming SMS messages and can send messages through your carrier's network.

3. User Requirements

3.1 Eligibility

You must:

• Be at least 13 years of age
• Have a valid phone number and mobile carrier service
• Use an Android device running Android 7.0 (API 24) or higher
• Comply with all applicable laws and regulations

3.2 Account Responsibility

If you choose to use Firebase authentication:

• You are responsible for maintaining the security of your Google account
• You must provide accurate and complete information
• You are responsible for all activities under your account

4. Acceptable Use Policy

4.1 Permitted Use

You agree to use SMS Gateway Master only for lawful purposes and in accordance with these Terms. You may:

• Send personal messages to friends, family, and contacts
• Receive and manage SMS/MMS communications
• Organize and search your message history
• Use the app as your default SMS handler

4.2 Prohibited Use

You agree NOT to:

• ❌ Send spam, unsolicited marketing, or bulk messages
• ❌ Harass, threaten, or abuse others through messages
• ❌ Send illegal content or engage in illegal activities
• ❌ Impersonate others or misrepresent your identity
• ❌ Violate any applicable laws or regulations
• ❌ Attempt to reverse engineer, decompile, or hack the app
• ❌ Use the app to distribute malware or viruses
• ❌ Interfere with or disrupt the app's functionality
• ❌ Collect or harvest user data without consent

5. Carrier Charges and Fees

5.1 Mobile Carrier Rates

SMS Gateway Master uses your mobile carrier's SMS/MMS services. Standard carrier message and data rates apply. The app does not control or receive any portion of these fees.

5.2 International Messaging

Sending messages to international numbers may incur additional charges from your carrier. Please check with your carrier for international rates.

6. Intellectual Property

6.1 App Ownership

SMS Gateway Master, including its design, code, features, and branding, is owned by Simpapp and protected by intellectual property laws.

6.2 License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use the app for personal, non-commercial purposes, subject to these Terms.

6.3 Your Content

You retain ownership of all messages and content you create or transmit using the app. We do not claim any rights to your messages.

7. Disclaimers and Limitations

7.1 "As Is" Service

SMS Gateway Master is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Guarantees of uninterrupted or error-free service
• Warranties regarding message delivery or receipt

7.2 Third-Party Services

The app integrates with third-party services (Firebase, Google Play Services, mobile carriers). We are not responsible for:

• Mobile carrier network outages or disruptions
• Third-party service failures or changes
• Issues beyond our reasonable control

7.3 Message Delivery

We do not guarantee that messages will be delivered successfully. Factors affecting delivery include:

• Mobile carrier network issues
• Recipient's device being off or out of service
• Blocked numbers or spam filters
• International restrictions

8. Limitation of Liability

To the maximum extent permitted by law, Simpapp and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of data or messages
• Lost profits or business opportunities
• Service interruptions or delays
• Unauthorized access to your device or account

Our total liability shall not exceed the amount you paid for the app (which is currently free).

9. Indemnification

You agree to indemnify, defend, and hold harmless Simpapp from any claims, damages, losses, liabilities, and expenses arising from:

• Your use or misuse of the app
• Your violation of these Terms
• Your violation of any third-party rights
• Content you transmit through the app

10. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

11. Changes to the Service

We reserve the right to:

• Modify or discontinue features of the app
• Update the app with new versions
• Change these Terms at any time

We will notify you of significant changes through in-app notifications or by updating the "Last Updated" date.

12. Termination

12.1 Termination by You

You may stop using the app at any time by uninstalling it from your device.

12.2 Termination by Us

We may suspend or terminate your access to the app if:

• You violate these Terms
• You engage in illegal activities
• We are required to do so by law

13. Governing Law and Disputes

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Romania, without regard to its conflict of law provisions.

13.2 Dispute Resolution

Any disputes arising from these Terms or your use of the app shall be resolved through good faith negotiations. If negotiations fail, disputes may be submitted to the courts of Bucharest, Romania.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Simpapp regarding the use of SMS Gateway Master and supersede any prior agreements.
